How Do I Sell an Inherited Home in Manzanita, Oregon?

Short answer: First confirm who has legal authority to sell. That could be the trustee (if the home is in a trust), a personal representative appointed through Oregon probate, or the heirs themselves. Next, get a date-of-death valuation for tax purposes. Then get the whole family aligned before you list. With those three things in place, selling an inherited Manzanita home works much like any other coastal sale. The difference is the emotion that comes with it.

This One's Personal

My family has a beach house too. I know what it's like when a place holds decades of summers, sandy floors, and handwritten notes in the guest book, and suddenly it's a line item in an estate. The paperwork is the easy part. The hard part is deciding together what happens next.

Here's the guide I'd give my own family.

Step 1: Who has the legal right to sell the house?

It depends on how the house was titled when your loved one passed:

  • Held in a living trust: The successor trustee can usually sell without going to court. This is the simplest path, and it's common for coastal second homes.

  • Held jointly with right of survivorship: The surviving owner typically records a death certificate and an affidavit, and then owns the home outright.

  • Transfer on death deed: Oregon allows these. The named beneficiary takes title without probate.

  • Owned in the deceased person's name alone: This usually means probate in Tillamook County Circuit Court. A court-appointed personal representative handles the sale.

Good to know: Oregon's simplified "small estate" affidavit only works when real property is worth $200,000 or less. Almost no Manzanita home qualifies, so most untrusted homes here go through probate.

Step 2: Can you sell a house during probate in Oregon?

Yes. Once the court appoints a personal representative, that person can typically list and sell the home while probate is still open. Oregon probate includes a creditor-claims period of at least four months after notice is published, so plan on a timeline of months, not weeks. A probate attorney will tell you what applies to your estate.

Step 3: What taxes apply when you sell an inherited house?

I'm a broker, not a tax advisor or attorney. Please bring your CPA and estate attorney in early.

Step 4: How do siblings agree on selling the family beach house?

In my experience, this is where most inherited-home sales stall. Some common situations:

  • One sibling wants to keep the house, one wants to sell, and one lives far away and hasn't said what they want

  • Unequal contributions over the years to taxes, repairs, or time spent at the house

  • Deciding what happens to the furniture, the art, and the sentimental items

What helps:

  • Get a real market value first. Decisions go better when everyone is working from the same number.

  • Consider a buyout. One heir can buy out the others at market value, often with a professional appraisal so it's fair.

  • Plan for carrying costs. Taxes, insurance, utilities, and coastal upkeep keep adding up while the family decides.

  • Save the keepsakes before anything else. Photos, the guest book, and the driftwood sign by the door. No one regrets doing this first.

Step 5: How do I prepare an inherited coastal home for sale?

  • Secure and insure the house. Tell the insurance company the home is vacant, because standard policies often limit coverage on unoccupied homes.

  • Clean it out gradually. Local estate sale companies and donation centers can help after the family has taken what matters.

  • Sell it as-is or update it? Older Manzanita cabins often sell well as-is to buyers who want to renovate. Sometimes a light refresh (paint, flooring, a deep clean) pays for itself. A local broker can tell you which applies to your house.

  • Check the short-term rental status. If the home was rented, confirm with the City of Manzanita or Tillamook County where its STR license or permit stands. Manzanita caps STR licenses in its residential zones.

  • Get a pre-listing inspection. Coastal homes, especially older ones, can hide moisture, roof, and foundation issues.

Can I sell an inherited Manzanita home if I live out of state?

Yes. Most of the inherited homes I work with belong to families spread across Oregon, Washington, California and beyond. With a local broker, a title company, and mobile notary signing, you may never need to make the drive, though many families choose to come for one last weekend.
